Contributors

As a compilation of images and other media, the Retina Image Bank is a copyrighted work of the American Society of Retina Specialists (ASRS). When uploading, contributors transfer ownership of their images to the ASRS. Likewise, when submitting slides, contributors transfer ownership of the digitized images to the ASRS.

After uploading, contributors retain the right to use their images for personal, educational, and nonprofit purposes, but images transferred to the Retina Image Bank cannot be sold, used for profit, or published elsewhere.

Contributors may upload as many images, diagrams, and case series as they wish. All will be reviewed by physician editors to ensure consistency of descriptions, keywords, etc. This review process will take approximately 1 to 2 weeks, after which approved images will move to the live site. If editors or members of the image bank staff have any questions about a submission, contributors will be contacted directly.

Contributors also may submit slide collections to the Retina Image Bank. Staff will scan all slides and upload the digitized images, and staff will work closely with contributors to make sure the proper descriptions and keywords are included with each upload. Slide collections will carry a source line that says the images are from the personal collection of the contributor. ASRS reserves the right to exclude slide-derived images that do not digitize with the highest possible quality.

Contributors are required to de-identify all submitted images when uploading. Electronic file names must be changed to remove all patient-identifying information. This may be done before or during the upload process. If images are submitted with patient names in the file names, contributors will be contacted to discuss renaming of the files.

Contributors may not upload images they do not own or have authority to upload. Please determine ownership before uploading if there is any doubt.

Contributors may not upload images that have previously been published elsewhere. Instead, contributors should upload outtakes of those images.

Visitors

Please read this document carefully before using the Retina Image Bank. This is a legal agreement between you (the end user) and the American Society of Retina Specialists (ASRS).

Your use of the Retina Image Bank signifies your acceptance of the terms of this License. If you do not agree to the terms of the License, you must not proceed into the ASRS’s Retina Image Bank, and you must return to ASRS any images from the Retina Image Bank currently in your possession.

License: By this license, you are granted the right to use the Retina Image Bank for noncommercial educational, informational, and research purposes only. You are not granted a right to use the Retina Image Bank for the purpose of journalism, investigation, or reporting absent a specific license granted by ASRS. The images and associated captions of the Retina Image Bank may be copied and used for oral educational presentations delivery by you along with any supporting documents needed for the presentation. ASRS requires that images taken from the Retina Image Bank include a notice of ASRS Copyright ownership in the form of:

“This image was originally published in the Retina Image Bank. Author. Photographer. Title. Retina Image Bank. Year; Image Number. © the American Society of Retina Specialists."

Restrictions: The Retina Image Bank is a proprietary, copyrighted, derivative work of the ASRS. You agree that you will not modify, rent, lease, sell any of the images, or create derivative works using the Retina Image Bank. You agree that you will not remove any notice of copyright, trademark, or other proprietary right from any place where it is on or embedded in the content. If you have any reason to believe that images from the Retina Image Bank are attributed to a wrongful ownership, you must report the discrepancy to ASRS.

Terminations: A license is granted each time an image from the Retina Image Bank is downloaded. The license is specific to the Copyrighted work obtained from ASRS. A license is effective until terminated or until the natural expiration of the Copyright in the images downloaded from the image bank. The ASRS may terminate any License at any time at its sole discretion. In the case of termination of any License, all Copyrighted materials or copies associated with this specific grant must be destroyed.

Disclaimer of Warranty on Retina Image Bank: You expressly acknowledge and agree that use of this Retina Image Bank is at your sole risk. THE RETINA IMAGE BANK IS PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND. No warranties are made that the Retina Image Bank will meet your requirements, or that the operation of this website will be uninterrupted, virus free, or error free. No warranty is given as to the accuracy or reliability of the data within the Retina Image Bank.

Limits of Liability: ASRS shall not be liable for any damages, including direct, indirect, digital, incidental, special, or consequential damages, or damages for loss of profits or revenues incurred by you or by a third party, whether in an action nor contract or tort, arising out of the use or application by you of the medical information and images contained within the Retina Image Bank.

Indemnification: You agree to indemnify and hold ASRS harmless from and against any claims, expenses, losses, or liabilities(including professional fees and expenses) in connection with any claim by a third party arising out of your use of any component of the Retina Image Bank or the application by you of the medical information contained in the Retina Image Bank.

Transferability: The rights granted to you by ASRS under this License of Agreement may not be assigned, transferred, or licensed to any third party. ASRS may transfer and/or assign at will this License to any third party, including any personal data associated with the ownership of the License.

Governing Law and Jurisdiction: This License will be governed by and construed in accordance with the laws of the State of Illinois or the United States District Court for the Northern District of Illinois, without regard to conflict of law principles. All suits, proceedings, or claims in connection with this License shall be brought in the courts of the State of Illinois in the County of Cook, and you hereby consent to the jurisdiction and venue of those courts. If any provision of this License is held by a court of competent jurisdiction to be invalid, unreasonable, or unenforceable, such provision or requirement will be enforced only to the extent that it is not invalid, unreasonable, or otherwise unenforceable and all other provisions of this License shall remain in full force and effect.

ASRS does not exert editorial control over materials that are posted by third parties on this site or materials that are e-mailed by third parties to any other persons.
